Service Agreement (Terms of Service)

Customer Acknowledgment.

Customer hereby acknowledges that Customer has read and fully understands the following terms and conditions which shall be deemed a binding part of Customer’s contract with Rezurect AZ for mobile detailing services. Customer further acknowledges that these terms and conditions are a material inducement for Rezurect AZ’s agreement to enter into a contract with Customer for said services.

Rezurect Mobile Arizona Estimates

Rezurect Mobile Detailing, (“Rezurect AZ”) is an auto detailer that comes to you! You agree that the prices are subject to change and the price to be paid is calculated on-site after a service pro confirms all services, vehicle types, and any add-ons.

Any price estimates are based on Rezurect AZs prior experience, without an inspection, and based on information provided by the Customer.

If, at the commencement or during the course of providing the Service, it is apparent that the actual cost of the Service will exceed the quote provided by Rezurect AZ, Rezurect AZ will provide the Customer with the option to pay an increased fee to complete the service or pay the quoted amount without the service being completed.

Complaints/Guarantee

You agree to inform Rezurect AZ within 48 hours if you are dissatisfied for any reason with the Service provided. You agree to choose one of the next 3 available days for a free re-detailing. Re-detailing must be completed within 7 days from the time of initial service.

All outstanding balances must be paid before a scheduled re-cleaning can be booked.

Extreme System Soiling

You agree if Solar Guardian AZ deems your system to be in extreme condition our Solar Guardian Pros will not be able to fully clean your system to our normal standards in our allotted appointment time and that you will need to purchase an additional Solar Guardian AZ service if you desire your system brought up to Solar Guardian AZ standards.

Outside Service Area

Solar Guardian AZ currently provides services to the Phoenix Metropolitan Area. We are expanding each year to other cities and counties. If an appointment is booked outside of our service areas, Solar Guardian AZ reserves the right to remove any discounts or we may require a trip fee of $15 to justify the travel distance.

Personal Belongings

Please remove all personal belongings, furniture, and plants from around your home prior to your appointment that you do not want to get wet or lose. Solar Guardian AZ and our Solar Guardian Pros are not responsible for the loss of personal items left around the property.

Payment Terms

The Customer agrees to pay Solar Guardian Arizona in full when the service is complete, unless otherwise agreed in advance in writing. You authorize Solar Guardian AZ to charge the credit card on file if no cash or check payment is received. All outstanding invoices 14 days and over are subject to a late payment fee of $25 plus any outstanding balance. If no payment is received immediately after service is completed, the customer authorizes Solar Guardian AZ to charge the customer’s credit card in the full amount of the invoice.

Convenience Fee

At Solar Guardian AZ, we strive to provide convenient and hassle-free services to our customers. As part of our commitment to delivering exceptional solar panel cleaning experiences, we have a convenience fee policy. The $9.92 convenience fee is applicable to all payments made through non-cash methods, such as credit cards, debit cards, or digital wallets. The convenience fee has been introduced to help us cover various expenses associated with processing electronic payments. These expenses include credit card fees imposed by financial institutions, transaction charges, and the costs of maintaining secure payment gateways. Additionally, the convenience fee also allows us to account for factors like rising operational costs due to inflation and fluctuations in gas prices, as we aim to provide consistent and high-quality services.

We want to ensure transparency and clarity regarding our convenience fee, so our customers understand its purpose and the value it adds to our operations. We encourage our customers to consider using alternative payment methods, such as cash, to avoid incurring the convenience fee.

Solar Care Program

Solar Guardian AZ offers yearly, bi-yearly, and tri-annual memberships for a truly clean solar experience without having to sign a contract. Discount pricing on memberships is subject to system size and interval of subscription. Solar Guardian AZ provides discounted services on the Solar Panel Cleaning + Complimentary Inspection when available for each type of membership. However, if a customer cancels their membership within 3 months, the customer agrees to pay the discount back and the customer’s card on file will be charged for the difference.

Coupons/ Offers/ Discounts

All coupons must be submitted during scheduling an appointment online or with a Solar Guardian AZ scheduler. Solar Guardian AZ will charge the customer the full price for services if the customer did not notify Solar Guardian AZ about a coupon at the time of scheduling. Any and all coupons or offers can only be used once and cannot be combined with any other coupons or offers, including the Solar Care Program discounts. Limit 1 per customer. Referral discount codes can be used one time per household and only if a referral actually had service provided.

Online Promotions and giveaways

All online promotions and giveaways are limited to Solar Guardian AZ’s service areas only. Online promotions and giveaways are not sponsored by the platforms they are shared on. This might include, but is not limited to: Facebook, Instagram, Tik Tok, or other social media platforms. If applicable, online promotions and giveaway end dates will be stated in the online posts. Winners will be announced online on our social media channels. Winners will be contacted via available methods, which will include but not be limited to text messages, phone calls, email, or direct messaging on social media. Soliciting Policy

You agree not to solicit for hire any staff member introduced to you by Solar Guardian AZ for any solar-related services. If you are found to have solicited one of our team members, please be advised you will be flagged in our system and you won’t be able to schedule a service with us anymore. We reserve the right to seek legal remedies for any violation of this policy (or any other provision of this Terms of Service).

Mobile Terms of Service

The Solar Guardian Arizona mobile message service (the “Service”) is operated by Solar Guardian Arizona (“Solar Guardian Arizona”, “Solar Guardian AZ, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Solar Guardian Arizona’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Solar Guardian Arizona through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Solar Guardian Arizona. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to Solar Guardian AZ or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device unless initiated by you. If you have subscribed to other Solar Guardian Arizona mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt-out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any shortcode or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Pigeon Proofing – Additional Service Agreement Information

Solar Guardian Arizona requires a non-refundable deposit of $150 upon booking a pigeon proofing appointment. This deposit enables Solar Guardian AZ to initiate the procurement of necessary products and secure a 72-hour window specifically allocated for your system.

A follow-up appointment may be recommended. Solar Guardian uses j-hooks to secure the guard, preserving your warranty. If you have any issues with the pigeon proofing after installation, contact us.

Limitation of Liability.

Solar Guardian AZ’s entire liability and your sole and exclusive remedy for any and all losses and damages for any cause of action arising out of services provided to you by Solar Guardian AZ shall be limited, at Solar Guardian AZ’s option and in Solar Guardian AZ’s sole discretion, to a refund of payment(s) for the service(s) at issue; a reclean; or, the repair of your solar system as determined by Solar Guardian AZ in its sole discretion. IN NO EVENT SHALL SOLAR GUARDIAN AZ BE LIABLE FOR ANY LOSS, LIABILITY, DAMAGE OR EXPENSE IN AN AMOUNT IN EXCESS OF YOUR ANNUAL TOTAL INVESTMENT, CUSTOMER EXPRESSLY WAIVES ANY AND ALL RIGHTS TO CLAIM ANY ADDITIONAL DAMAGES, INCLUDING BUT NOT LIMITED TO: ANY LOSS OF USE OR PROFITS, LOSS OF BUSINESS, LOSS OF BUSINESS REPUTATION, EXPENSES OR COSTS ARISING FROM OR ALLEGED TO ARISE FROM BUSINESS INTERRUPTION, DAMAGE TO REAL OR PERSONAL PROPERTY, AND FOR CONSEQUENTIAL, INCIDENTAL, INDIRECT, PUNITIVE, OR SPECIAL DAMAGES CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE, TORT, STRICT LIABILITY, BREACH OF CONTRACT, BREACH OF WARRANTY OR OTHER BREACH OF DUTY BY SOLAR GUARDIAN AZ.

Governing Law – Venue.

All disputes between you and Solar Guardian AZ shall be governed by Arizona state law and resolved exclusively in the state or federal courts located in Maricopa County, Arizona.

Class Action Waiver.

TO THE FULLEST EXTENT PERMITTED BY LAW, CUSTOMER EXPRESSLY WAIVES ANY AND ALL RIGHTS TO MAKE A CLAIM FOR DAMAGES AS A CLASS MEMBER IN ANY CLASS ACTION OR AS PART OF A PLAINTIFF GROUP. You and Solar Guardian AZ agree that each may bring claims against the other only in your or its individual capacity and not as a member of any class or as part of a class or representative action. Unless you and Solar Guardian AZ agree, a court may not consolidate any dispute between us with disputes involving other people OR PARTIES.​
